EARTH TO BOB YOUNG: WHY DO YOU PROTECT POLLUTERS?
Michigan Environment Suffers From Young’s Decisions

LANSING – As Michigan celebrates Earth Day, the Michigan Democratic Party (MDP) noted Supreme Court Justice Bob Young’s repeated protection of polluters at the expense of the environment.

“Whether it’s denying citizens access to court to protect the environment, refusing to protect natural treasures like the Au Sable River or indifference to people exposed to dioxin, Bob Young has been a disaster for the Michigan environment,” observed MDP Chair Mark Brewer. “His favoritism toward the polluters who put him on the bench is unconscionable. The sooner the voters remove him from the Court – and they will have that opportunity in 2010 – the cleaner and safer Michigan’s environment will become.”

In 2007, Young wrote the decision in MCWC v. Nestle (479 Mich. 280) which overturned decades of precedent and closed the courthouse door to citizens seeking to protect the environment. In Henry v. Dow Chemical (473 Mich. 63), Young joined a decision denying relief to victims of dioxin contamination. In Anglers of the Au Sable v. DEQ (No. 137725) (2009), Young would have allowed an oil company to dump waste water in the Au Sable River.
